Legislative Report, March 29, 2016

The Mission Advocacy Committee met by conference call on 03/28/2016 and reviewed additional bills.

They have been included in the Bill Status Report though they still must be acted upon by the Executive Committee.

Those bills include HB 2706 (Support); HB’s 2705. 2727,2732, 2794, 2668 and 2669 (all Opposed).

All Association members were invited to listen in to the call via a post on The Landing.

The General Assembly comes back today, Tuesday March 29 with seven weeks left in the session. Everyone hopes that being away from the Capitol for eleven days has allowed the members to reflect on the issues before them and resolve to put hurt feelings aside and focus on the things that need to be done.  There are some contentious issues and potential veto overrides ahead so hang on it could be a bumpy ride.

Below is a Bill Status report as of March 29.  Some of our major issues include:

HB 1862 by Rep. Cross which modifies provisions relating to landlord/tenant law.  This has passed the House and is in the Senate Committee on Judiciary Civil/Criminal Jurisprudence.  I’ve spoken to Senator Dixon the Committee Chair and he understands the importance of the legislation and hope to be able to hear it sometime fairly soon.

HB 1970 by Rep. Anderson has been assigned to the House Committee on Emerging Issues, Rep. Haahr chairs that committee and I’m working on getting a hearing on the bill. The bill is strongly opposed by all of the municipal water suppliers so it’s going to be a very contentious issue.

SB 572 by Sen. Schmitt adds minor municipal violations to the limitations passed last session on traffic fines (SB 5). On Monday, March 28, the AP reported that “Cole County Circuit Judge Jon Beetem ruled that the law” (SB 5) “unconstitutionally targeted St. Louis-area municipalities with revenue caps lower than other Missouri cities.”  This will make it more challenging to address the problems in SB 572.  It clearly hit a nerve since the House hearing on the bill attracted a full house of city functionaries urging the defeat of the measure. I testified in support of the bill.

Repeals provisions regarding nonjudicial foreclosure proceedings and requires all foreclosure proceedings to be handled judicially.

 

Remarks:

Oppose, in states with judicial foreclosure the time it takes to get a property back on the market tends to be significantly greater than in states without judicial foreclosure. Other issues include higher rates of interest to borrowers and empty properties creating problems for neighbors.

Remarks:

Oppose, sales tax on services. To be fair to Sen. Emery the Resolution does exempt Professional Services from the sales tax and those are defined to include real estate brokerage services. Also exempted are real estate sales and rental. However, if this were to be put in place there would be significant pressure in the future to impose those taxes on the exempt classes.
