Capitol Update: March 12 | With Spring Break Just Around the Corner, Industry Legislation is on the Move

The week before spring break is always a hectic one in the General Assembly, and this week was no exception.

On Tuesday, the House Committee on Emerging Issues heard HB 695. This bill allows a real estate licensee to own an unlicensed LLC that can accept commission payments. When the House returns from spring break, the committee will hear HB 1124 on advertising guidance. Following the committee hearing, both bills will likely be merged into a House Committee Substitute and move forward accordingly.

Additional issues of interest:

 

  • HB 162 which contains the LLC provisions in now in the House Committee on Rules and Administrative Oversight. The final step before going on the calendar for debate.
  • HB 697, focused on PACE legislation, is on the House Perfection Calendar, as is HB 69, which tightens up restrictions on the sale of scrap copper and other metals.
  • We testified in support of HB 36 which provides property owners additional tools to protect their property from trespassers.
  • John Black has reintroduced the Targeted Industrial Manufacturing Enhancement Zones Act which provides additional tools for communities to attract new business. Frankly, I had missed this reintroduction. However, because REALTORS® within Rep. Black’s district attended REALTOR® Days, he discussed it with them and they with me. That’s one of the great things about REALTOR® Days; they increase the opportunities to discuss issues and give your lobbying team additional opportunities to connect with legislators. Long story short, we testified in support of the bill (HB 379) on Thursday morning.

 

Overall, the Senate was busy this week. They passed a gas tax bill and a version of Wayfair (sales tax on internet sales). Not to be outdone, the House passed their version of Wayfair and legislation dealing with local government emergency powers and tightening up the initiative process.

The House and Senate will not be in session next week but will resume on March 22.

Moving on to REALTOR® Days, we had another great week in Jefferson City. On Tuesday, members of the Greater Springfield Board of REALTORS® and Bagnell Dam Association of REALTORS® spent the day meeting with their respective Senators and Representatives, including Governor Parson. On Wednesday, in addition to speaking with Senator Sandy Crawford about real estate legislative topics, members of the Kansas City Regional Association of REALTORS®, Central Missouri Board of REALTORS®, and West Central Association of REALTORS® had the opportunity to speak in support of MONA (Missouri Non-Discrimination Act) with Senator and bill sponsor (SB 81) Greg Razor.
